June 4, 2004. Attorney Puleo filed a four page motion to dismiss for lack of service:

At first this looks like a good motion. The law is stated well. What ever happened with this motion? The problem with this type of defense is that they simply mail it again, but it buys you some time. Main thing: The judge says

“Son, you are wasting the court’s time. Obviously you received the notice. You sent me a copy of the envelope! I recommend that you open up the envelope and consider yourself served! I am awarding fees to the other side. This is a frivolous motion. If that is the best that you can do, well you are in for some trouble in my busy court.”

Question: Tom, do you have a septic tank?

Who installed it?

Did you do the percolation test?

Hmm. Why can’t they make some kind of exception to the rule? Why did you not get a permit? I know. They would not give you one. Right?

This septic tank thing has become oppressive. I know that they want to do a percolation test.

Maybe we could open the thing up with a backhoe and let em do their test.

If they denied you a permit, then they are at fault.

Please write a chronology about what happened regarding your septic tank. And a list of players. Or call me and I will write it down.
